These Terms and Conditions (“Terms”) govern the Genesis Membership Program
(“Membership”) offered by Genesis Sprinklers (“Genesis,” “we,” “us,” or “our”). By enrolling in the Membership, you (“Member,” “you,” or “your”) agree to be bound by these Terms.
Membership Overview
The Genesis Membership is an annual subscription program designed to provide residential clients with exclusive benefits, including locked-in pricing, free services, and access to premium features. Membership is available only to eligible existing residential clients of Genesis Sprinklers. Commercial clients are not eligible for the Membership.
Eligibility
- Membership is limited to residential services in Manatee County, Florida, and Sarasota in Sarasota County, Florida.
- Commercial services are excluded from Membership eligibility and benefits.
- Existing clients may enroll at the introductory rate of $39.99 per month (billed monthly via autopay) or equivalent annual prepayment. New clients, if eligible in the future, will pay the standard rate.
Membership Duration and Billing
- Membership is annual and auto-renews on the anniversary date unless canceled in accordance with Section 4.
- Payment is due monthly via autopay at $39.99 (introductory rate for eligible existing clients) or annually in advance.
- All payments are non-refundable, and there are no refunds or credits for unused portions of the Membership term.
Cancellation Policy
- Members may cancel their Membership by providing written notice (email or mail) at least 60 days prior to the desired cancellation date.
- Cancellations with less than 60 days’ notice will incur a charge for the balance of the 60-day period (e.g., immediate cancellation requires payment of the next two months; 30 days’ notice requires payment of one additional month).
- Genesis reserves the right to cancel any Membership not paid in full for abusive use (e.g., excessive or fraudulent claims of benefits), effective immediately upon notice to the Member.
Failed Payments and Suspension - Failed payments will immediately suspend Membership benefits.
- Members have 30 days from the failed payment date to update payment information and reinstate the Membership by paying a $15.00 processing fee plus any outstanding amounts.
- Memberships suspended for more than 30 days are permanently released. Released Members may only re-enroll by paying the full annual cost upfront at the then-current rate (no introductory pricing).
Benefits
All Members receive the following benefits during an active Membership period:
- One (1) free service call per year (subject to availability). A “service call” covers the truck, tools, and technician’s transportation to the site only; additional labor, parts, or repairs are charged separately at locked-in rates.
- One (1) free annual tune-up (covering up to 4 zones; additional zones at member rates), schedulable June–August with at least 30 days’ notice.
- Locked-in access to pre-2026 pricing for services and parts.
- Free access to the EdenPro irrigation reporting app.
- Access to beta programs (e.g., pest control/fertilization, lake/pond management, landscape lighting).
- Bundled savings not available to non-members.
- Monthly newsletter.
- Note: Priority service is not included but may be added for an additional $14.99 per month.
Benefits are subject to availability and may not be combined with other offers unless specified.
Non-Transferability
Memberships are non-transferable and may not be assigned to another person, property, or entity (including upon sale of the serviced property).
Data Privacy
Client data collected through the Membership, EdenPro app, or related services is protected by industry-standard software used by Genesis Sprinklers. No data is stored locally on unsecured devices, and access is restricted to credentialed team members only. We comply with applicable federal and state privacy laws.
Limitation of Liability
Genesis Sprinklers is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the Membership or use of benefits. Our total liability shall not exceed the amount paid by the Member in the 12 months preceding any claim.
Force Majeure
Genesis is not responsible for delays or failures in providing benefits due to events beyond our reasonable control, including but not limited to acts of God, weather events, supply chain disruptions, or government regulations.
Changes to Terms
We may update these Terms from time to time. Members will receive notice of material changes via email at least 30 days prior to the effective date. Continued Membership after the effective date constitutes acceptance of the changes.
Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from the Membership shall be resolved in accordance with Manatee County, Florida code and applicable federal or state laws, with venue in Manatee County, Florida.
